Terms of Service

You may use BookPassage only if you can form a binding contract under applicable law. You are responsible for maintaining accurate account information, safeguarding your credentials, and all activity that occurs under your account.

We may suspend or terminate accounts that violate these terms, infringe the rights of others, create legal or operational risk, or misuse the service.

You may use BookPassage only in compliance with applicable law and these terms. You may not misuse the service, interfere with its operation, attempt unauthorized access, scrape or exploit the service in an abusive way, introduce malicious code, or use the service in a manner that violates the rights of others.

We may change, improve, suspend, or discontinue any part of the service at any time, with or without notice.

You retain ownership of the content you submit to BookPassage, including images, extracted text, corrected passages, notes, and related materials. You grant BookPassage a non-exclusive, worldwide, limited license to host, store, reproduce, process, and display that content solely to operate, maintain, and improve the service.

You represent that you have the rights needed to submit your content and that your use of the service does not infringe, misappropriate, or otherwise violate the rights of any third party.

Some features may require a paid subscription. Pricing, billing cycles, trial terms, renewal terms, and included features are presented at the time of purchase. If you subscribe through the Apple App Store or another platform, billing is handled by that platform under its own terms and policies.

Unless otherwise stated, subscriptions renew automatically until canceled. You are responsible for managing or canceling your subscription through the platform where you purchased it. Refund eligibility, if any, is determined by that platform's rules rather than by BookPassage.

If you download or use the app through a third-party platform such as Apple, you also agree to that platform's applicable terms. To the extent required by platform rules, the platform and its subsidiaries are third-party beneficiaries of these terms as they relate to the app.

BookPassage and its related branding, software, design, service materials, and other content made available by us are owned by BookPassage or its licensors and are protected by intellectual property and other applicable laws.

Except for the limited right to use the service under these terms, no right, title, or interest in our intellectual property is transferred to you.

If you provide feedback, suggestions, or ideas about BookPassage, you grant us the right to use them without restriction or compensation to you.

BookPassage is provided on an as is and as available basis to the fullest extent permitted by law. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the service will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, BookPassage and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or use arising out of or relating to your use of the service, even if advised of the possibility of such damages.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless BookPassage and its affiliates, officers, employees, contractors, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of your content, your misuse of the service, or your violation of these terms or applicable law.

You may stop using the service at any time and may delete your account from the Profile tab in the app. We may terminate or suspend access if you violate these terms or if continued access could create legal, security, or operational risk. Certain provisions of these terms will survive termination, including provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.

These terms are governed by the laws of the State of California, without regard to conflict of laws principles. To the extent a claim is not required to be resolved in another forum under applicable law, you and BookPassage agree that the state or federal courts located in California will have exclusive jurisdiction over disputes arising out of or relating to these terms or the service.

We may update these terms from time to time. If we make material changes, we will post the updated terms here and update the last updated date above. Your continued use of the service after the updated terms become effective means you accept the revised terms.
